Directive 2014/24/EU


2. Other justification for the award of the contract without prior publication of a call for competition in the Official Journal of the European Union

The procurement falls outside the scope of application of the directive: Yes

3. Explanation

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
The contracting authority considers it is acting legitimately, and considers that it is justified in its view that it is not required to publish a contract notice in the Official Journal of the European Union. It is the contracting authority┐s case that aligning housing related support contract dates will allow an organised transition to one future contract. The Floating Support and Sheltered Housing support service contracts expire on 31st July 2019. There is no capacity in existing contracts to extend further. The Sheltered Housing contracts were extended to the maximum extension term from the original contracts. The Floating Support contract was due to expire in January 2019, this was extended via a waiver agreement to align the end date to the Floating Support service contract. The Short Term Supported Accommodation (STSA) contract ends in October 2020. The Council seek to align the Floating Support and Sheltered Housing contract end dates with the STSA contract end date to allow consultation in relation to aligning all of these services through a consultation process over the next 12-15 months, into one future contract.
Hence Telford & Wrekin Council is publishing this transparency notice and invoking PCR 2015 Regulation 72 (1) (c).
