2. Other justification for the award of the contract without prior publication of a call for competition in the Official Journal of the European Union

3. Explanation

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
The contracting authority considers it is acting legitimately, and considers that it is justified in its view that it is not required to publish a contract notice in the Official Journal of the European Union. The School Nursing contract expired in August 2017 and the contracting authority exercised its contractual right to extend the arrangement until March 2018. In April 2017 the contracting authority having commenced planning for the re procurement of the Health Visiting and School Nursing contract took the view that it would adopt a procurement strategy for a full competitive tender. Coincidentally a number of other Councils were also going out to tender at the same time. After conducting a supplier engagement event and acquiring market intelligence and feedback from economic operators, partners and neighbouring contracting authority┐s on their specific supplier engagement experiences also, it has become clear to Telford & Wrekin Council that there is no developed market for these services outside the incumbent supplier that is already in place namely Shropshire Community Health Trust. In order to address the lack of interest by economic operators an alternative proposal is now being considered and developed by the Strategic Commissioning Group in conjunction with the Clinical Commissioning Group which is to place Health Visiting and School Nursing into the scope of broader community based services which it is hoped will facilitate better re-procurement. It has also been acknowledged that arrangements and opportunities for delivering services locally are likely to change significantly over the next year. The requirement to delay the procurement and enter into a further contract extension from April 2018 with Shropshire Community Health Trust was not foreseeable because although having acted diligently Telford & Wrekin are faced with the prospect of no service provision. The services being provided under the contract is continually evolving and requires particular review and redesign to ensure fitness for purpose in the interests and benefits of service users. Hence Telford & Wrekin Council is publishing this transparency notice and invoking PCR 2015 Regulation 72 (1) (c).
