Telford & Wrekin Council (¿the Council¿), a Waste Collection and Disposal Authority for the purpose of the UK Environmental Protection Act 1990, is seeking to enter into a contract or contracts for the collection, collection, transport, handling, recycling, composting, treatment and disposal (including disposal (by whatever means) of all off-take products and treatment residues) of its municipal waste and the management of its Community Recycling Centres (CRC). The successful contractor(s) will be responsible for marketing and selling any products (e.g. recyclable materials, compost and treatment residues) and for securing and managing any residual landfill capacity that may be required. The services will be provided in respect of waste arising from households, including bulky items, street cleaning waste, gully emplying waste, waste from litter collections, waste from fly tip clearance and may include wastes from Council buildings, schools and businesses. The services will include relevant associated services such as the provision and distribution of containers and dealing with ¿ad hoc¿ waste items which may require special treatment. Depending on the solutions proposed, the services may include the design, build, finance and operate of a waste transfer station to accept the Council¿s waste. Certain elements of the services will commence on 1 April 2014 with the remainder to be phased in in accordance with the expiry of the Council¿s existing waste management contracts, although some of the phased in services may commence early. The contract(s) will deal with approximately 89,000 tonnes of contract waste per annum.

II.2.1)Total quantity or scope:
The Council is seeking to replace (over time) its existing waste management services and accordingly is seeking to award a contract(s) that will be phased in between April 2014 and April 2019. The expiry date for the contract(s) will be [31 March 2034], irrespective of when the services come on stream, so that all services will end at the same time. The contract(s) will include an option to extend the contract period for any period or periods up to a further five (5) years.

The details and dates of the expiring contracts are set out in the PQQ Information Document but the Council will discuss with Bidders during dialogue whether some of the later services may commence earlier.

The Council is looking for a value for money solution but is also clear on the standards of service that must be provided for residents, businesses and visitors and its needs and requirements will be set out in the descriptive document which will be included with the Invitation to Participate in Dialogue. The Council has set out below its current waste management contracts but is also looking for a flexible service that will allow for new innovative services (such as new recycling or organic waste initiatives or collection routines and the possibility of introducing additional CRC site management and/or refurbishment).

The Council recognises that a waste transfer station may be necessary in or adjacant to the borough and securing a site for any new facility proposed will be a matter for Bidders.

Contracts currently in existence and requiring replacement by this procurement are:
a. Dry recycling collection and treatment from 2014.
b. Residual waste disposal from 2014
c. Residual waste collection from 2019.
d. Green waste collection and treatment from 2019.
e. Community Recycling Centre (¿CRC¿) management and transport, treatment and disposal from 2019.

The PQQ Information Document (access code: Tenderbox GF4355756R) provides detailed information of when each of the existing contracts end and the dates for new contracts under this procurement to begin.

This procurement is not seeking a like for like replacement of the existing contracts and it is expected the waste management service now being procured will include some element of treatment of residual waste and instead of letting a series individual contracts, the services will be let either as a single contract or two (only) separate contracts. This will mean that a contract may have phased start dates for different elements of the services. The new contracts are described in the Lots below. Bidders may bid for one Lot or for all Lots or any combination of Lots but they will need to demonstrate at PQQ stage sufficient economic and financial standing as well as technical ability for the Lots/combinations which they intend to bid for. The Council envisages that for each Lot three (3) Bidders will be invited to participate in dialogue but the Council reserves the right to invite up to six (6) Bidders per Lot.

The contracts will cover all aspects of the services, as relevant for each Lot.

Bidders should seek independent legal and commercial advice in relation to the potential value of the opportunity of each Lot or overall project value.

As a minimum, maintain the current alternate weekly collections for households within the borough, collection of the current range of recyclable materials and provide and distribute replacement containers. b) Collection and transportation of Residual Waste from April 2019.
As a minimum, maintain the current alternate weekly collections for households within the borough and provide and distribute replacement containers. Provision of alternative collection solutions as required.

c) Collection and transportation of Organic Waste - from April 2019 for green waste.
As a minimum, maintain the current alternate weekly collections of green waste for households within the borough and provide and distribute replacement containers. Other organic collections, such as food, may be required before April 2019 or at some time during the period of the contract.

d) Collection and transportation of Commercial Waste (to meet statutory requirements) from April 2019.

e) If relevant to the successful contractor¿s solution, the provision of a local delivery point to accept contract waste from April 2014. This may involve the design, build, [finance] and operation of a ¿new-build¿ waste transfer station or may involve the use of a contractor (or sub-contractor) owned waste transfer station already in existence.

f) CRC Management and Onward Transport of residual waste and organic waste to Transfer Station or specialist Treatment/Disposal Facility from April 2019.

The Council requires flexibility from the contract(s) and throughout the life of the contract(s). The Council intends to work with the successful contractor to develop the contract to meet its needs and explore opportunities to manage waste materials not currently collected and treated/disposed of by the Council.

At final invitation to tender stage, the Council will require the final bidders to confirm that their financial and reputable position has not altered since they were prequalified at the start of the process. As this could be a significant period of time since the data was provided, the Council reserves the right to request updated information and review this data in accordance with evaluation scheme initially used at pre-qualification stage. Should the position have changed this may impact on the contract award decision and the bidder may not be awarded the contract.

The Council will adopt a contract structure or financing model that best meets its needs and may adapt the contract documentation as appropriate to the solution. Expressions of interest in response to this contract notice may be submitted by a single bidder or a consortium. The Council reserves the right to require, prior to contract award, the groupings of consortium members to take a particular legal form or to require a single contractor to take primary liability or to require that each party undertakes joint and several liability. In any event, in the case of a consortium bid, the partners must make clear how they intend to deliver the services (e.g. through a prime/sub-contractor route or by forming a special purpose vehicle).

VI.4.2)Lodging of appeals: In accordance with Regulations 32 and 32A of the UK Public Contracts Regulations 2006 (as amended), the Council will incorporate a minimum 10 calendar day standstill period from the date upon whch information on the award of the contract is communicated to Bidders. Any request for additional information by Bidders pursuant to Regulation 32(9)can be obtained by contacting the address set out at 1.1. Aggrieved parties who have been harmed or are at risk of harm by a breach of the rules may pursue a further appeal in relation to the award of the contract to the High Court, details of which are set out in section VI.4.1. Any such action must be brought promptly and in accordance with the timescales set out in the Public Contracts Regulations 2006 as amended. If the contract has been entered into the Court may, depending on the circumstances, award damages, make a declation of ineffectiveness, order the Council to pay a fine, and/or order that the duration of the contract be shortened.

The purpose of the standstill period referred to above is to allow any aggrieved parties to apply to the courts toset aside the award decision before the contract is entered into.
