Other justification for the award of the contract without prior publication of the contract notice in the OJEU
In order to benefit from the reduced time-limit referred to above, in addition to the box(es) to be ticked above, please explain in a clear and comprehensive manner why the award of the contract without prior publication of a contract notice in the Official Journal of the European Union is lawful, by stating in any case the relevant facts and, as appropriate, the conclusions of law in accordance with the Articles in Directive 2004/18/EC (500 words maximum):
The Contracting Authority concluded that as a result of the irregular tenders which it received in connection with a competitive dialogue procedure commenced pursuant to OJEU Contract Notice 2012/S 128-212562 of 06/07/2012, it was unable to continue the procurement under the Competitive Dialogue procedure. All bidders were informed in writing of the discontinuance of the Competitive Dialogue procedure. The Contracting Authority subsequently used the Negotiated Procedure in accordance with Regulations 14(1)(a) of the Public Contracts Regulations 2006 as amended and invited all bidders who submitted a detailed solution in the discountinued Competitive Dialogue procedure to participate in the ensuing negotiations. All tenders received were evaluated in accordance with the published evaluation methodology issued in the invitation to Negotiate and the decision to award in accordance with that evaluation was made on 4th February 2014.
